제도분석틀(IAD)을 활용한 지방정부의 비선호시설 입지갈등 해결과정 분석 -서산시 자원회수시설 사례를 중심으로-

본 연구의 목적은 비선호시설 입지갈등의 구조적 원인과 갈등해결과정의 문제점을 사례연구를 통해 분석하는 것이다. 이를 통해 지방정부의 공공갈등 접근시각 및 해결방식의 적극적 변화를 위한 정책적 시사점을 도출하였다. 사례분석은 Ostrom의 제도분석틀(IAD)을 응용한 사례분석틀로 갈등과정을 분석하였다. 그 결과 갈등발생의 원인 및 해결과정의 주요 문제점으로 지방정부의 일방적인 사업추진과 공공기관의 구조적 문제가 여전히 걸림돌로 나타났고, 갈등관리시스템은 영향을 미치지 못하였다. 그러나 주민과 시민단체의 강력한 저항은 지방선거에 영향을 미쳤고, 단체장의 갈등인식 및 문제해결 접근방식을 전환 시켰으며, 문제해결기제로‘공론화위원회’가 적절하게 활용되었다. 실천적 과제로 첫째, 지역주민들에게 일정한 개발 이익을 돌려준다는 피해자 중심의 ‘이익 분배(benefit sharing)’의 입장이어야 하며, 둘째, 협력적 거버넌스의 주체로서 시민환경단체와의 적극적인 소통이 필요하며, 셋째, 지방정부는 정책결정 및 갈등해결과정의 어느 단계라도 필요에 따라 협상・조정・중재 등의 대안적 해결방식이나 숙의 기법들을 적절하게 도입하고 활용할 수 있어야 한다. 다만 단체장이나 관료사회의 결정 회피나 결정 번복을 위한 정당화 기제로 활용되어서는 안 된다.

A Study on the Resolution Process of Unwanted-Facility Siting Conflicts at the Local Government Level Using the IAD Framework: Focused on the cases of Seosan Rescource Recovery Facility

The purpose of this study is to analyze the structural causes of conflicts over unwanted-facility siting and problems in the conflict resolution process through case studies. Through this, implications for active change and conversion of local governments' perspective on public conflict approaches and solutions were derived. The case analysis analyzed the conflict process was analyzed by the case analysis framework applying the institutional analysis of E. Ostrom used as an analysis tool. As a result, the cause of the conflict and the main problems in the resolution process were the unilateral promotion of local governments and structural problems of public institutions, and the conflict management system did not affect. However, strong resistance from residents and civic groups affected local elections, changed the group leader’s conflict perception and problem-solving approach, and the “Deliberation Committee” was appropriately used as a problem-solving mechanism. As a practical task, first, it should be in the position of victim-centered “benefit sharing” to return certain development profits to local residents, and second, active communication with civic environmental groups is necessary as a subject of cooperative governance. Third, local governments should be able to properly introduce and utilize alternative dispute resolutions and deliberative techniques, such as negotiation, mediation, and arbitration, as necessary at any stage in the policy-making and conflict-solving process. However, it should not be used as a justification mechanism for avoiding or reversing the decision of the head of a group or bureaucratic society
