제주특별법에 나타난 권한 특례 유형 분석

국가는 제주특별자치도 출범 이후 여섯 차례의 제도개선을 통해 제주도의 입법형성권과 정책형성의 자율성을 크게 강화하였다. 이러한 성과에도 불구하고 제주특별법의 목적 중 핵심적 내용인 고도의 자치권 보장과 행정규제 완화가 충분하지 않아 특별하지 않은 특별자치도라는 평가가 출범 초부터 현재까지 계속되고 있다. 본 연구는 이를 검증하기 위해 권한이양의 방식, 권한이양원칙, 자율성 유형에 기초하여 분석틀을 형성한 후 제주특별법에 나타난 권한 특례 유형을 분석․평가하였다. 첫째, 제주특별법에 규정된 특례 유형을 다섯 가지, 즉 제1유형 특례 창설, 제2유형 일반법의 특별법 이관, 제3유형 장관 권한의 도지사 이관, 제4유형 시행령의 조례 이양, 제5유형 법률의 조례 이양으로 구분하였다. 둘째, 이러한 유형에 따라 제주특별법에 규정된 6,010건의 권한 특례를 분석하였다. 그 결과 제주자치도의 적극적 자율성을 가장 강화하는 법률의 조례 이양 특례(제5유형)는 전체의 1.9%, 제한적이나마 자치입법을 통해 자율성을 강화하는 시행령의 조례 이양 특례(제4유형)는 45.0%를 차지하였다. 나머지 53.1%는 제주자치도의 자율성을 소극적 수준에서 강화하는 제1・2・3유형으로 나타났다. 본 연구는 제주자치도의 특별성이 강화되지 않은 이유를 이러한 권한 특례 방식에 있다고 보고 제주자치도의 적극적 자율성 확보를 위해서는 법률의 조례 이양 특례(제5유형)와 시행령의 조례 이양 특례(제4유형)를 확대해야 한다고 제안한다.

A Study on the Typological Analysis of Power Devolution System in Jeju Special Self-Governing Province Act

The state has delegated exceptional administrative powers from the central government with the aim of fulfilling the objectives of the Jeju Special Self-Governing Province (hereinafter referred to as “JSSGP”) since its inception. However, despite nearly two decades of these efforts, the core provisions, including assurances of enhanced autonomy and relaxation of administrative regulations as outlined in the Jeju Special Self-Governing Province and the Development of Free International City Act (hereinafter referred to as “JSP&FIC Act”), have not been realized. This study, therefore, seeks to explore avenues for enhancing the effectiveness of the JSP&FIC Act in achieving greater autonomy for the JSSGP.
To achieve the objectives of this study, this study categorizes power devolution into five types: exceptional case introduction, exceptional legal cases, executive power devolution cases, administrative work devolution cases, and exceptional ordinance cases. Based on an analysis of 6,010 cases, it is revealed that administrative work devolution accounts for 45.0% of the cases, while exceptional ordinance cases comprise only 1.9% of the total. The remaining 53.1% consists of exceptional case introductions, exceptional legal cases, and executive power devolution cases, which have a relatively limited impact on strengthening the autonomy of the JSSGP. This suggests that the current level of devolution from the central government to the JSSGP falls short of endowing it with autonomous decision-making power and improving its distinctiveness. Consequently, this study recommends that the central government should prioritize the transfer of its powers to the JSSGP through exceptional ordinance cases. Such an approach would enhance the JSSGP's right to self-determination and autonomy within the framework of the JSP&FIC Act.
