지방자치단체장의 부패 실태 분석과 개선방안

본 연구는 지방자치단체장의 부패 실태를 분석하고 개선방안을 제시하는데 목적이 있다. 공무원 부패는 자원배분의 왜곡뿐만 아니라 사회 전반의 경쟁력을 저하시키고, 민주화와 경제발전에 걸림돌이 되는 가장 주요한 원인이라는 점에서 공직자의 도덕성과 청렴함이 대표적인 요건으로 부각되고 있다. 그럼에도 불구하고 공무원 중에서도 가장 영향력이 높은 지방자치단체장의 부패는 지속적으로 발생하여 지역에 비효율성을 초래하고 있다.
기존연구와의 차별성은 기존 연구는 지방자치단체장의 부패를 기소현황을 중심으로 접근하였으나, 본 연구는 부패 기준을 사법부의 당선무효 수준의 범죄확정 판결로 설정하였다. 특히, 일반적인 부패 현황 외에도 시기별(임기내 및 임기외), 지역별 그리고 반복적인 부패 실태를 조사하여 분석하였다. 추가적으로 반복적으로 부패가 발생하는 지역 관계자를 대상으로 인터뷰를 실시함으로써 정책적 함의를 도출하였다. 분석결과, 부패 발생요인을 지역토착세력에 의한 조직적 선거활동을 비롯하여 정당공천제의 한계를 제시하였으며, 부패를 완화하기 위해 선거절차의 투명성이 우선되어야 하고 지방의회의 감시권한 강화와 선출직 공무원의 선출횟수 및 교차 출마 제한을 제시하였다. 본 연구는 민선 8기(전국동시지방선거)를 1년도 채 남겨두지 않은 상태에서 시기적으로 부패에 대해 접근함으로 연구의 가치가 있다고 여겨진다. 그 외에도 2022년부터 시행되는 지방자치법 전면개정으로 인한 지방의회의 권한과 역할에 관한 연구에도 기여할 것으로 생각된다.

Analysis and Improvement of Corruption Status in Chief of Local Government

The purpose of this study is to analyze the corruption status in chief of local governments and to present improvement measures. The morality and integrity of public officials are emerging as representative requirements in that corruption of public officials not only distortion of resource allocation but also degrades the overall competitiveness of society and hinders democratization and economic development. Nevertheless, corruption in the chief of a local government, which has the most influence among public officials, continues to occur, causing inefficiency in the region. This is because the performance of the relevant organization changes as the specificity that the chief of local government represents a local government and the influence on the promotion of residents' welfare and the improvement of the quality of life of local residents are concentrated on the chief of the organization.
The difference from previous studies was that existing studies focused on the current status of prosecution in the chief of local governments, but this study set the corruption standard as a criminal decision at the level of invalidity of election by the judiciary. In particular, in addition to the general corruption status, the corruption status by period (within and out of office), region, and repetitive corruption status were investigated and analyzed. In addition, the implications of policy points were derived by conducting interviews with local officials who repeatedly experienced corruption. As a result of the analysis, the limitations of the party nomination system, including organized election activities by local forces, should be prioritized to alleviate corruption, strengthen the monitoring authority of local councils, and restrict cross-runs. This study is considered valuable by approaching corruption in a timely manner with less than one year left before the 8th popular election (national simultaneous local election). In addition, it is expected to contribute to the study of the authority and role of local councils due to the complete revision of the Local Autonomy Act, which will take effect in 2022.
