지방자치단체 거주 외국인 주민의 권리에 관한 연구

세계화에 따라 인구의 전지구적 이주 현상이 지속적으로 증가하여 전통적인 국민이나 시민은 아니지만 특정 사회의 공동체 구성원으로 살아가는 외국인이 늘어나고 있다. 이에 지역에 정착하여 살아가는 외국인 또는 이민자를 일컫는 데니즌쉽(Denizenship)에 대한 관심도 높아져 가고 있다. 이러한 관점에 따르면 지역에 거주하는 외국인 주민은 정치적 참정권이 인정되는 시민의 자격을 갖는 주민과 공적 서비스 대상으로서 거주자의 자격을 갖는 주민으로 나눌 수 있다. 우리나라는 2005년 법 개정으로 영주체류 자격이 있는 외국인에게 지방선거 투표권을 인정하였고, 이어 주민투표권, 주민소환권, 조례제정개폐청구권 등이 인정되어 외국인의 정치적 참정권은 계속 확대되어 왔다. 그러나 실제 외국인의 참정권 행사는 제한적이며, 오히려 지방자치법상 주민의 권리인 거주자로서의 권리는 큰 관심을 받지 못하였다. 거주자로서의 권리는 영주체류 자격 없이 90일 이상 체류하는 대다수 외국인 주민에게도 인정할 수 있는 법이 규정하는 주민의 권리이다. 이 권리를 실질적으로 누릴 수 있도록 하는 것이 외국인 주민에 대한 별도의 지원정책을 마련하는 것보다 외국인 주민의 권익 향상과 사회적 갈등 예방에 더 효과적일 수 있다.

An Exploratory Study of Denizens’Socio-political Rights in Local Communities in Korea

With the increasing global migration trend, a new demographic group, the number of foreign resident in local communities who are not considered citizens in the traditional sense is also on the rise. Such denizens, who live in immigrant-receiving countries as legitimate members of their host country’s society, represent a new demographic group. This study attempts to review who denizens are and what rights they enjoy as a social member in Korea under the current legal and institutional governance framework. Denizens are different from citizens, in that denizenship describes the status of foreigner or immigrant who have settled in local communities of their host countries. In relation to the rights of local citizens, denizens have two different classes of rights: they may enjoy full political franchise rights or they may merely be endowed with public-service access rights. The revision of the Korea Immigration Act in 2005 expanded the political rights of permanently resident immigrant denizens from local election voting rights to the right to recall elected officials or to open or close local ordinances. However, the exercising of such political rights has been limited, and little public attention has been directed at denizens’ social and political rights under the Local Government Act. Of the two classes of denizens’ rights, that of providing access to public services can and should be applied to all types of immigrants in Korean society regardless of their type of visa and length of stay in the country. This gives rise to several suggestions regarding what policymakers should consider in the process of supporting and integrating immigrants in local communities in Korea.
