주민자치조직의 제도적 변화와 한계 분석
-주민자치위원회와 주민자치회 비교를 중심으로-

주민자치를 실현하고자 하는 정부의 정책적・제도적 노력으로서 우리의 대표적인 주민자치조직이라 할 수 있는 주민자치위원회와 주민자치회는 외형뿐만 아니라 기능이나 역할에 있어 변화가 있어왔다. 이러한 변화에도 불구하고 주민자치제도의 변화에는 여러 한계가 있음이 지적되고 있다. 이에 본 연구는 읍・면・동 단위로 시범실시되고 있는 주민자치회를 이전 주민자치위원회와의 비교적 관점에서 조직 설계, 조직 구성 및 조직 운영의 차원에서 분석해 보았다.
2013년 이후 시범실시되고 있는 주민자치회는 기존의 주민자치원회와는 법적 근거, 법적 지위, 위원 위촉권자, 기능 및 역할, 지방자치단체장(또는 읍・면・동장)과의 관계, 그리고 일반 주민의 참여라는 측면에서 변화된 내용을 찾아볼 수 있다. 이러한 점진적 제도변화는 부분적으로 새로운 제도나 규칙으로의 대체(displacement)가 나타나기도 하였지만 주로 기존의 규칙이 수정되거나 새로운 요소가 추가되는 가겹(layering)의 유형이 나타났다.
주민자치회가 기존 주민자치위원회(주민자치센터)의 주민자치 기능이나 역할의 한계를 보완하고자 하는 취지에서 출발하였다면 기존의 제도나 규칙과는 다른 관점과 내용으로 접근하여야 할 필요가 있다. 특히 주민자치제도의 구성과 운영에 있어 전국 읍・면・동의 지역적 특성과 자치 환경을 고려해 주민자치조직 설계를 위한 제도적 재량권이 지방자치단체와 지역 주민에게 부여되어 주민자치의 다양성 추구와 함께 주민자치의 공간적 범위도 실질적인 주민자치가 가능한 수준에서 설계되어야 할 것이다.

An Analysis on the Institutional Changes and Limitations of Residents Autonomous Organization: Focused on Comparison Between Residents Autonomous Council and Residents Autonomous Committee

As the government’s policy and institutional efforts to realize resident autonomy, the Residents Autonomous Committee and the Residents Autonomous Council, which are representative the residents’ self-governing organizations, have changed not only in appearance but also in function and role.
Despite these changes, it has been pointed out that there are several limitations to the change in the residential autonomy system. Therefore, this study analyzed the Residents’ Self-Governing Council, which is being piloted, based on the theory of gradual institutional change in terms of organizational design, organization composition, and organizational operation from a comparative perspective with the Residents’ Self-Governing Committee.
The Residents Autonomous Council can find changes in terms of legal basis, legal status, appointment authority of members, function and role, relationship with local governments, and participation of general residents. Although some of these institutional changes were displaced by new systems or rules, there were mainly types of layering in which existing rules were modified or new elements were added.
From this point of view, if the Residents' Autonomous Council started with the aim of supplementing the limitations of the functions or roles of the existing Residents' Autonomous Committee, it is necessary to approach it with a different perspective and content from the existing system or rules. In particular, in the composition and operation of the resident autonomy system, institutional discretion for the design of the resident autonomy organization would be given to local governments in consideration of the regional characteristics and autonomous environment. In addition, discretion and opportunities would be provided to local governments and local residents in the design of the spatial scope of resident autonomy.
